It depends on how long you were on disability and even under what circumstances the employment was ended.

CAN ANY ONE HELP?
by: Anonymous

I AM ON FMLA, RIGHT NOW. I AM UNDER SO MUCH STRESS THAT THE DR PUT ME ON FMLA DUE TO MY EX THREATENING TO KILL ME ABUSE AND NOW HAVE A THREE YEAR RESTRAINING ORDER, HAD TO BE ESCORTED IN AND OUT OF WORK, MAKING IT HARD FOR ME TO SLEEP, WORK WAS GETTING HARDER AND MAKING MORE MISTAKES, GOING HOME EVERY NIGHT WAS VERY HARD AND WAS DISTURBING. NOW MY TIME IS ALMOST UP ON MY FMLA, I DON'T WANT TO LOSE MY JOB TO MISTAKES NOR DO I WANT TO GO BACK HOME. WOULD I BE ABLE TO COLLECT UNEMPLOYMENT WHILE STAYING WITH MY FAMILY, IF I QUIT MY JOB BECAUSE I DON'T FEEL THAT I CAN DO IT ANYMORE IN MY OLD ENVELOPMENT AND I GIVE THEM MY REASONS AND TWO WEEK NOTICE? PLEASE HELP.

Hi Anonymous,

I hope this helps because you need to make a new life for yourself a considerable distance from this .. animal that has you feeling this way.

Please see the California UIBDG Section D #3. It's possible in California, but you still have to prove the good cause .. namely medical documentation, police reports and restraining orders.

For those in different states experiencing spousal abuse, child abuse, stalking .. etc., etc., and wondering whether your state is caring enough to allow for unemployment benefits should you decide to reasonably voluntarily quit your job .. I suggest reading this pdf on the subject provided by NELP. (National Employment Law Project).

There is a list of states that actually have provisions in their statutes and some that have precedent court cases which have created the exceptions without a precedent.

I think the exception should be required by the FUTA.
