Can I be denied unemployment benifits if terminated and will I ever be able to get any of those benefits.

by Chuck
(Riverside, CA)

Can I be denied unemployment if I was terminated from a position in California? If so... Can I be denied 100% of the benefit or do they still pay a lower amount?

Hi Chuck,

Of course you can be denied unemployment if you were terminated for misconduct.

You can also appeal a denial, but if you let the denial stand you might be able to still get some of those benefits your were denied if you return to work and earn 5 times your weekly benefit amount and then suffer a "qualifying" separation from work.

That is how you "purge" a disqualification to gain access to the remaining benefits based on the wage credits from the employment you were denied unemployment for.
