Can I collect unemployment if I have been fired due to allegation...

I was recently placed on administrative leave for a psychological abuse allegation. I worked at a group home and when I went to defend myself to the Q and A department I was accused of telling an individual to say inappropriate statements that they would not have the knowledge to say on their own. This was not true and I denied ever doing so or knowing of anything remotely similar to it happening. Another week went by and I was called to meet at the main office for the outcome. I arrived to find my boss and the head of HR, in which my boss informed me the allegation had been found substantiated and that my employment with the company had been terminated. I was devastated and did not ask any questions because I just closed up emotionally. I do not know what proof they have to go by, I do not know if other co-workers were questioned and I do know that the individual is not in the state of mind to make such an accusation. I have been an over-all dedicated employee of almost 5 years and have never had such an accusation against me. I haven't fought for any proof only because I am a person of quality who see's an upside to everything and have only looked upon this situation as a blessing in disguise and chance to move ahead in my life.

Well then, I don't know if you'll be able to collect unemployment, because the only ones who know the quality of the "substantiation" is the employer.


If you proceed with the unemployment process, how will you ever be able to focus any attention to the reason the employer did not have good cause to terminate you. They conducted an investigation .. first request a copy from the employer .. they'll probably not make it easy for you either.

You said you have taken the view this is a blessing and you can now move ahead in your life, but what if that future includes the need for another job .. possibly in the same field .. this same job that has accused and then terminated you for what sounds like a major "ethics violation". What's your resume going to look like? How will this employer respond to prospective employers?

What does this mean?

I ask you why, if this is true, you're here asking if you can collect unemployment.

Unemployment benefits, especially under circumstances such as yours can be a battle of strategies.

Whether someone quits or is fired, a distaste or inability to confront the issues at hand when they are presented will not serve you well later on .. like now.

I was fired after 23 years with one company. The owner fought the unemployment and now I can't ever get unemployment. Or so I'm told. But how can someone quit and only have to wait 6 weeks?



What state do you live in. And why do you say you can't "ever" get unemployment?

That's not how it works .. unless maybe you live in a state with a gross misconduct provision and a written admission of theft was used to disqualify the person for years.

And by the way, I really want to know what state you're in.

Most states require that you return to work in subsequent employer and earn x amount times your weekly benefit amount before you can requalify .. whether you quit .. or were discharged.
