i was sick over a month ago for 5 days. i called in to report my abences every day. when i returned to work i provided the required doctors note. my note did not cover all the days i was gone as i missed more then expected due to a reaction to the medication i was provided and did not make it back to the doctor office to get a new note before returning. i filed short term disability and all days were covered there. the claim is currently open. i was fired today for a forged doctor note. the 11 was now a 14. i did not do this and am pretty sure it was my supervisor as she had personal issues with me. but it is my word against theirs.
Hi Lynn,
He said / She said. Credibility will rule the day. And credibility is judged by the ALJ at the hearing, either way the initial determination goes, because someone will appeal. But of course the employee has the "forged or altered" document.
Do you happen to have a copy of the original?
Is there any possibility you can get documentation from your physician about the additional days? Did you speak to him about the "reaction" even if you didn't get a note?
Is there anyway you can prove this supervisor is not above such an awful deceitful thing to do? Maybe a witness?
