CAN I GET UNEMPLOYMENT

by TOMIA
(NEW YORK STATE)

I'M AFRAID... MY JOB HAS AN ATTENDANCE POLICY AND I'VE BEEN SICK LATELY. I HAVE USED UP MY TIME AND NOW I HAVE A FINAL WARNING FOR ATTENDANCE. I HAVE A DOCTORS NOTE STATING THAT I NEED TO MISS WORK FOR TWO DAYS.. WILL I RECEIVE UNEMPLOYMENT ANY WAY WITH THAT DOCTORS NOTE TAKING ME OUT OF WORK?

Hi Tomia,

It is very possible that you will receive unemployment with that doctor's note.

Even if you are on a final written warning for attendance and the employer fires you.

If you have to file for unemployment .. just make sure that when you have the phone interview you make the adjudicator aware that you have a doctor's note and offer to fax it .. and then follow through.

Just so you can rest a little easier, check out New York's resource of precedent decision for unemployment See section 1110 #17.
