Can I quit and get benefits?

by Laurel
(Shortsville, NY)

I have not been paid in over four weeks. This means that my employer owes me two paychecks. He does not respond to my emails, he does not answer my requests.

I have bills to pay.

In the past, he has issued me paychecks that have bounced and that has caused me to pay bills and then my checks bounce. I find this to be more than abusive.

Hi Laurel,

I'm sure you can .. but first you need to check the links here: http://www.labor.state.ny.us/workerprotection/laborstandards/faq.shtm#16

You do have a recourse other than just quitting that you should explore first ... why just settle for unemployment???
