Denied because of school in illinois.

Hello
I worked at a restaurant while being a full time student until February of 2009, I applied for unemployment in Illinois in May and got accepted and I continued to be a full time student, It hasn't been until a few weeks ago( January 2010) that the school officer for the unemployment office denied me benfits for being a full time student. I have appealed, what are my chances of winning since i've been a full time student the whole time and Should I recomend an In-person hearing so I could show them my past school records and if I lose the case will I have to re-pay the benfits that I got already while being a student? Thank you for your help.



Hi Jeff,

Did you inform the state, when you applied that you were a full-time student?

Because this is what the USDOL says Illinois's stance on collecting while being a full time students.

"Yes, ineligible when principal
occupation is a student unless
attends approved training."

Yes, I did inform the IDES that I was a full time student. I find it kind of weird that the Adjucator would just deny me now.
Should I try to appeal still?


My advice is if in doubt or unclear .. always appeal to preserve your appeal rights. Then get busy researching your issue.

For those that live in Illinois I suggest the Unemployment Insurance Law Handbook It contain a digest of adjudication precedents. Very useful.
