i had to fight a guy off of me at work it was clearly self defense they got statements from a manager and some of my fellow co workers that spoke in my favor.



And they fired you even with all the witness statements? Appeal.

receive unemployment

I got into a fight with a young lady 28 and I am 50 yrs old then was terminated can I get unemployment


I don't know .. do you think you deserve to get benefits? If so, tell me why you think you should be allowed to get them.

I WAS TERMINATED AS WELL I DIDNT START IT IT WAS INSTIGATED BY A COWORKER SHE FOLLOWED ME TO 3 LOCATIONS IN THE STORE TILL FINALLY I WAS CORNERED N I HAD TO MOVER HER OUT OF MY WAY TO GO THROUGH THE DOOR SHE VERBALLY ASSAULTED ME AND I HAD TO DEFEND MYSELF AND GET OUT AND I WAS TO BLAME??




I don't know if you were to blame, but I can tell you that employer's often discharge both parties involved in such an occurrence, but it doesn't mean for the sake of unemployment benefits that both parties would be found to blame at an unemployment hearing.

fired for fighting

I was fired from my job because some guy decided to fight me and i defended my self only after he came up to my truck yanked open the door and started to assault me so i beat him down.

My job fired us both i was denied for gross misconduct is that right i had to defend myself.




Answer For: Fired for fighting



Employers fire both employees because to do otherwise wouldn't be a uniform enforcement of the policy against fighting even though they know that sustaining the burden at an unemployment hearing might be an iffy proposition for both now.

They just need employees with a tendency of creating conflict or getting physical. It's disruptive for the rest of us that just want to do our jobs and then go home.

And yes, this does happen to even the innocent that need to defend themselves and I would of course advise them to appeal because the employer's case is often based on conflicting stories from the two participants in the incident when there are no other first hand witnesses.

However, I didn't do what I used to do without being quite aware that many employees needed to just be fired, regardless of unemployment issues.

And aren't you lucky to be the first victim of my Pre New Year resolution for 2012 to stop writing only about getting unemployment and start giving some of my more subjective opinions to those I believe help to create the problem for those I consider the collateral damage of unemployment.

Those few words raise all kinds of questions for me .. about you.

And here's just a couple.

I wonder why, if you had the power to beat him down, why you didn't use restraint and reason to control the situation.

I wonder what you said to provoke such a response.

I wonder how culpable you were for your own discharge.
