(FL) Changed from hourly wage to commission
by Jason

Hello,
I was recently receiving unemployment benefits but after several months I found a full-time Job. I was working an hourly wage at over 40 hours a week. Then they were dropped to 30. I was then forced to transfer to another part of the company. I now work only on commission. I?m there almost 40 hours plus but barely make any actual hours at all. I have just passed my 90 day probation period. Is there anything I can do? I can't afford to work there but am afraid to quit. What actions can or should I take? Is there anyway I can get partial benefits?
Hi Jason,
You can't get partial benefits if you work fulltime.
The only possibility depends on whether the change from hourly to straight commission is a substantial change in the employment.
They look at a number of things. And how long you have been working under the change. There comes a point ( I not sure when ) that you quit because you either refused to continue working due to an "unreasonable" or substantial change in the employment or staying appears to be an "acceptance" of the new conditions and they'll deny benefits.
When it comes to matters of being paid .. they really do expect us to give it a chance .. and that's not a bad thing because we then have paystubs to prove there was in fact a substantial change caused by how your pay is structured and you can show the difference from when you started to the end.
They (I mean the state) should also take a look at whether you would have accepted the job when you were first offered the job if the conditions now present would have deterred you from accepting it as "suitable work". You can find the definition of suitable work in the
statutes Please do understand this though .. quitting because you made more on unemployment is not good cause .. the reason for the quit must be attributable to the work.
