Florida - Can a telecommuter for an out-of-state employer collect FL unemployment?

by Lynn
(Naples, FL)

I have worked for the same employer for 12yrs as a telecommuter while residing in Florida. The employer is now eliminating telecommuter positions and requiring a move to another state. Since I declined to make such a move, I will be laid off from my employer around Nov '09. The employers corporate office is in CA. Will I be able to collect Florida Unemployment Benifits?

Hi Lynn,

I don't think you should have a problem since the employer is in California, but I do know that if the employer were based in NY State .. it's extremely difficult if not downright impossible because of a New York decision .. just google New York unemployment for telecommuters .. and New York telecommuter+tax to see what the issues can be when one telecommutes.
