I am collecting unemployment benefits my boss appealed

by alison
(miami, florida )

If the referee reversed the decision what does this mean?

You lost your benefits and you'll probably have to repay them.

Employer appeal
by: Lisa C

I am in the same boat except my employer are attorneys. They terminated me for "unauthorized practice of law." I was initially granted benefits to which they are appealing. A hearing is to be scheduled. In PA, I can still get my benefits during the appeal process. I plan to appeal any unfavorable decisions. It is my understanding that if the decision goes against you then benefits have to be repaid. In PA, if you get benefits and you are found at fault then benefits must be repaid with interest. If found not at-fault but benefits were denied, then the amount owed would be applied to future claims. Meaning if you file for benefits in the future, they will not be paid until the amount owed is repaid. Good Luck!

Unauthorized practice of law eh? You should get into unemployment .. you don't have to be an attorney in PA to even be a hearing referee.

What you were talking about is the the difference between a non-fraud and fraud overpayments.

There's a detailed chart at the USDOL
