Is it possible to get unemployment benefits after being fired for a random drug test?



I was wondering what my chances of winning an unemployment phone hearing were if I had been fired after failing a random drug test.



It depends on whether the state has a provision specific to how and why random drug test must be conducted by the employer, the circumstances, that prompted the drug test, what you did for a living, whether the employer has a drug testing policy you were made aware of at the time of hire .. etc., etc.

What I don't think is that someone should appeal or represent themselves at an unemployment hearing for this. At least I wouldn't of .. if this had ever been a concern to me.
