I will begin attending law school in one week and I am currently collecting unemployment. Am I legally able to continue collecting? Thank you!

Hi there, you future attorney!

The type of school is a moot point.

A basic eligibility requirement for collecting "regular" unemployment benefits is .. you must be able and available for work .. "suitable work" in fact.

Don't take my word for it use the fairly decent interpretive resource NY provides for unemployment issues.

Most states have nothing public to access and then the best resource available are the comparative chartbooks at DOLETA.

College and Unemployment

My girlfriend will be laid off this month. She qualifies for unemployment. I want her to go back to college and think this is the best time. Can she collect unemployment and attend college? I've seen contradicting facts. I'm under the impression that your eligible duration for collecting unemployment is extended when attending college. However I have also seen in the Q & A statements that you must be completely availiable and willing to find work.

Any information to clear up this misunderstanding would be totally appreciated. I'm only looking out for the best interest for my girlfriend.

Tell you what. If you can provide me with a link to where you are finding the conflicting information. I'll provide you with the link to the NYS unemployment index on the subject of attending college while collecting unemployment in NY.
