Side Business

can i collect unemployment benefits during temp. layoff from my primary employer if I have a seperate side business?

Hi,

Did you have the side business while you were working too?

Honestly, you should ask the state you are collecting from.

Others have asked the same question and been told different things by different states.

The theme seems to be that they want to find out if you already had the business or if it will be a new venture .. and of course they want you to report what you do earn so they can calculate "partial unemployment benefits".

The issue that comes up is that they question your ability and availability for regular work.

Another thing to consider is if your employer knows about your side business .. they may bring it to the states attention.
