Unemployed Stories

Unemployment and Injury

I live in NYS and have been collecting unemployment for a few months. If I become injured and have to have surgery, how will this affect my unemployment and what steps do I need to take?

Having a surgery will make you not able and available for work .. therefore when you file your weekly claims .. report it as such .. better still call the unemployment office and talk to them.

When you are released by your doctor to go back to work .. you can pick up your claim again .. as long as it hasn't expired in the interim.

what will happen to the wages during or time or recovering will you still receive them?

Where you received the injury would be of importance as to from what you received a temporary and partial wage "replacement".

I am only assuming there would be some sort of short-term disability if the injury was not work related because this is a question from New York.

New York mandates that employers to provide STD at 50 percent of your normal wages for up to 26 weeks.
