Avoid Unemployment Fraud At All Cost .. Please!!!!
Unemployment Fraud is an unemployment issue I've tried to avoid addressing directly when I reference it to the other legal issues. But the constant stream of comments, questions and even emails I get focused on committing fraud or reporting spur me to write this, so I can have a page to send them to. For those of you that believe you have a legitimate fight against an overpayment determination, read on, I'll get to you soon. But it's time to put my personal feelings out in front and start editorializing anyway. What better than unemployment fraud to start with. It doesn't matter to me personally if you're guilty of intentional unemployment fraud or whether you just want to anonymously report someone you assume to be guilty and use one of those prevalent "report fraud" buttons on any state unemployment website. But the fact that you're trying to find your spine by involving me, makes me want to scream something not very nice. Yup, you two people piss me off more than you'll ever know. Anyway I look at it .. I would come out the loser and be culpable in some personal kind of way, if I were to talk to you nicely. It's that you're either now looking for a way out the predicament you got yourself into with the system or worse, you're a petty, holier-than-thou-my-shit-don't-stink-type. It's you that needs to look for your redeeming qualities .. not me. So, to get you off my back, I'm going to address the differences between the the two types of overpayments there just so happens to be in what else .. the unemployment laws.
Intentional Unemployment FraudIf you have received a determination which says something about "misrepresentation of material facts" .. or something else that implies you cheated your way to benefits .. Request help from an Unemployment Hearing Rep They will evaluate your case .. and if you tell them the truth they may be able to help you where I cannot. Why is telling the truth important?
Non Fraud Overpayments and Possible WaiversThere is a reason intentional fraudsters finally get their comeuppance, but it's not going to be me that initiates it.However, there are a lot of people that know they made a mistake when filing their claim and want to know what to do about it now. I just hope I didn't lose any of you before I got to this point. The ramifications of ignoring an inadvertent mistake can be scary and long lasting and in fact it is the ignoring once aware of the mistake that becomes intentional and ignorance isn't the best of defenses when it comes to proving an overpayment should be held as a non-fraud overpayment. And it's also sometimes tough to explain away inadvertent mistakes that took you to long to correct .. because they could have been avoided if you'd of bothered to read the claimant handbook the state sent right after you applied .. these are all online somewhere.

Please note: Prison terms are generally the same for employers and claimants alike and due to many states being a little short on cash .. they are going after long term unemployed people's benefits. It's ridiculous and makes any state digging for dirt now .. after they allowed benefits .. as bad as those two different people I mentioned in the beginning. It's always the collateral damage I know exists that breaks my heart so I've tried to address prevention of that problem .. and prevention mean you can't stay ignorant of what may effect you.
