What happens to your unemployment benefits if you have to go to jail for a couple of weeks in the state of California

by Anonymous
(California)

I had got an under the influence back in Nov.08 and now I must serve my time on the sentence what do I do about my unemployment benefits, can I still collect or put a stop to it and will I be able to start it up when I get out?

Hi Anonymous,

You would be not be able and available for a couple weeks and therefore, not eligible.

You should read this part of the CA eligibility guide.

What Happens Once You Get Out of Jail
by: Anonymous

I understand that while you are incarcerated you would not be available for work. If you mark on the form that you are unavailable to work, do you have to specify why &/or does this kick off a flag that they set up a phone interview? Once I get out of jail, would my eligibility resume or does the incarceration terminate the claim?

That's a good question and the CA benefit guide does address unemployment and incarceration (AA360 C)
