Can they make me go back?

When I was laid off, the company I worked for said my position had been eliminated. That was three months ago. They recently called me back and said that if I don’t return to work they will consider me a voluntary quit. I do not want to go back to this company because I am starting school in the fall and quite honestly don’t feel comfortable going back there. Since they have contacted me my unemployment has stopped. Can I fight this and win?

Hi,

First, if your unemployment has been stopped there has to be a communication from the state telling you why .. so you can appeal the “determination”.

All your former employer has to do is tell the state you were “recalled” to work and unless your schooling is “approved training”, if not, yes .. they can do this. It would be well worth your time to read the statutes for whatever state you are in.

You should be most interested in valid reasons to “refuse suitable work”.
