Employer told me I was suspended for a week without pay then changed her mind and fired me.

(Tennessee Unemployment Benefits – Fired for Misconduct)

My employer did this over text. First she said she was putting me off for a week without pay due to my scratching lottery tickets. On my denial letter it states that I was warned once for that.

She never wrote me up and I never signed anything, Then she texted me and said she was going to let me go.

She will not talk to me, and i was denied unemployment i still have her text messages saved in my phone. I am appealing.

Good for you. Appeal, appeal appeal.

At least I’d appeal if the employer didn’t have a rule about scratching or buying lottery tickets and I had no idea that doing so would be something to put my job in jeopardy. Of course, I would not personally scratch lottery tickets on my employer’s time .. I’d wait for a break.

Written warnings are for letting people know they have broken a reasonable rule and that further occurrences of breaking said rule could result in termination of employment.

Hard copies of text messages are definitely something I would call legitimate documentation.

Seems to me, even employers could use some training to avoid “stupid texting”.

I was being bullied & emotionally abused by my boss. I tried to whistle blow, and found myself fired. I cried to a friend at work. They’re calling that misconduct! Now I’m going through the appeals process. I worked there 3 1/4 years before the trouble started. Before that, I had excellent attendance and excellent reviews. What changed? The more the boss felt inadequate, the more she projected it onto me!

Months To Find Another Job? A Response From An Employer.

Does it really take months to find another job?

I let someone go today for attendance and the first thing out of their mouth was “I won’t be able to get unemployment!”

If people spent more time respecting their employers and the policies and guidelines set out to ensure everyones success, unemployment wouldn’t be such an issue. There’s work out there, find it and stop mooching. And scratching lotto tickets, unless they are the company’s tickets, is milking the clock. Why would one think that scratching tickets while being paid to work is okay? It’s stealing paid time, right? Anyway just my $0.02. Good luck. Find work damnit.

I think I’ll let your comment through .. and see if it draws more opinions than just mine.

I think part of the problem some unemployed people face today, lies in the fact that some employers and even responsible employees, believe employer status goes hand in hand with unquestioned ethics and morals .. not to mention, that all employers will uniformly enforce those rules and guidelines which I too believe are essential to a productive workplace.

But, it’s the generalizations that are ridiculous and blind to the factors human nature plays and it’s true, employers themselves often fail to follow their own rules and guidelines.

To lift a person up to pedestal status just because they decided to become and employer is ridiculous. The unqualified elevation in status is something that is proven to be questionable many times over in the details of some unemployment appeal hearings.

I keep using the word some because to do otherwise would be on the same par with your assumption that unemployed people collecting unemployment benefits are deadbeats .. just because they are collecting benefits doesn’t mean they don’t deserve or need benefits because they also don’t want to find a job.

Here’s a question for you employer, do you watch the news? Do you know that former middle class people are now living below the poverty level?

The length of this recession has become unprecedented there is a lack of job creation to fill the vacancy of jobs left by business wanting to do business cheaper.

I might even go so far as to suggest that what we are experiencing today is the result of trickle down economics .. defying gravity.

well finally got it they paid me all my back pay and everything they found it wasn’t misconduct.

well we had it,the boss was on one end and then me and the ref, or whatever they are called. my ex boss had a witness, surprise surprise, this lady has her head so far up the bosses butt.

Anyway, she didn’t know the day she fired me and she did admit to laying me off for a week before letting me go then she started calling me a liar and a thief.

I hope they see she is not management material waiting to hear.

However, I would of also liked to of read about what you also did to counter the employer’s burden to prove misconduct was the cause.

I’m not really sure how being management material has anything to with an unemployment appeal .. as that is part of the problem with employment .. there’s way to many people managing employees that are clueless as to how to do that yet they are quite capable of giving compelling testimony .. even when they are perjuring themselves.

Ok it has been 8 wks and now they are saying 10 wks. Come on how long do they think we can wait?

Did you contact your attorney general office yet?

Were they of any use .. or do you still need to contact them? This is what has worked for many people in the state of FL .. so why not TN ..

tennessee is the state and i called them and they said eight weeks, what if i hear nothing in 2 more weeks, my bills keep rolling in.

If you want to try to prod the UI department along then it’s best to contact the state office that usually oversees unemployment programs.

waiting on appeal date

why does it take so long to get a date for an appeal, they told me 6-8 wks. it has been 6 and still nothing.

Possibly because of the continuing high unemployment rate and maybe .. hopefully, more unemployed people are appealing so the dockets are full, full, full?

What state?
