Fired for being sick

I had my heating a week ago don’t think it went well. I was told to submit questions.I did but they were questions for my employer like why she stole my c.c.tips and if I was made to stay after work and do floors why wasn’t I paid min.wage. I told the judge I was denied for making 390 times less than min wage under flsa law wasn’t it up to employer to make sure I made min.wage. His response was I’m not sure flsa is for tipped employers.

My employer wasn’t even at the hearing so I never asked questions.

The judge asked why if I was fired in April did I wait till July to file.I replied that wasn’t true. I sent several copies of papers called numerous times and it wasn’t until June 23 when I sent papers again was told wait 8 weeks for papers.

I called again no one knew what I was talking about.in my closing I asked judge how can anyone say what my true wages were since I showed proof of time cards shorted hours.and I was only required to report 6percent of tips.Judge said I was by law supposed to report every penny.that’s not what my employer said.so I don’t think my appeals went well .how long does it take to get results

I suppose if I really wanted to answer this question again, regarding any state, my questions to you would be to first ask whether we’re talking about an Arizona appeal hearing?

And then to verify the ALJ actually told all the parties at the hearing it would take two weeks for the hearing decision to be issued, or that it could take up to two weeks to issue a hearing decision?

During my appeal, I was the only one, while the representative, manager, Team Lead was present during the hearing . Representative answered first ring, but! It took five times times calling the manage. The time was 8:15, which didn’t start until about 8.38am, my manager didn’t get anything right, he didn’t know what time I started, my days off, even that I came to the Job to the job, was told to go get the doctor’s note, I would be off work. From the 9/10 til 9/ 25. I called off up until the 16th, forgot to call on the 17th, so I went and told my Team Lead, she told me if I came with the doctors paper, she would take me off schedule, my day’s off were, Saturday and Sunday. I went there on that following monday. I was told I was terminated for a no call, no show on for the 21st, 22nd and 23rd. It was the 21st. I came with the doctors note, I gave them my badge, USB, they wouldn’t allow me to sign nothing. Then I get a letter stating terminated on the 25th. My team lead didn’t inform, she spoke with me on the 17th. The manager even informed under oath, he had no regulation of me coming to the job. The representative even ask if he was given the doctors note, would have taken me off the schedule, he said yes. When the meeting first took place, they tried to say, I was a no call/ no show from the 9/9 til the 9/25th. But! They also stated that They did see me on the 9/17 and 9/21. Even with the medical paperwork. That do go with what I was telling them.why is it taking so long for a decision. It’s 01/08/16.

I thought you said you were fired ..

So you’re going to have to explain even to me, why you spent so much time on FLSA, stolen tips and minimum wage law (all possibly directly relevant to a voluntary quit) instead of addressing the reason you were fired, as told by the employer to the Arizona unemployment department.
