I am being laid off from and job. I am forced to retire so I can retain my health benefits. Am I eligible for unemployment?.

(NY Unemployment Benefits)

I am being laid off, so I am forced to retire in order to retain my health benefits. Can I collect unemployment benefits? I work in NYS

Hi,

I think you might want to rethink that decision knowing the following. Please read the NY precedent decision at #8

And then consider the fact that when retirement pay is coming from your base period employer the retirement pay affects the amount of your unemployment benefits .. in fact, retirement can wipe out a weekly benefit amount when the retirement pay is entered into a partial benefit formula.

See table 5-16 and then what NY has to say about unemployment benefits and retirement.
