I am on unemployment can I quit my job because my employer is commiting unemployment tax fraud and still collect? – Pennsylvania

I work for a company that laid me off in January of 2008. Now the company wants us to work 40 hours a week for a pay reduction so that we can still collect UE. I know it’s not legal and I don’t want to work for a company that is doing this to it’s employees. If I quit can I still collect UE until I find new employment? I don’t care about the company as far as legal actions I just want to see if I can still collect UE? With the job market being so bad I really need UE until something else comes along.

I’m sorry, you’ve only provided enough information for me to speculate about what’s going on here.

What is the deal the employer is offering you that would even enable someone to collect partial unemployment benefits?

What law tells you this is illegal?

If you haven’t worked since Jan 09…how much can you have left to collect?

Unemployment tax fraud is not something an employer would want to get caught doing .. the penalty is usually the same .. no matter whose committing fraud.

I actually meant 2009 not 2008 in my original post. What makes me feel it is illegal is that the unemployment law states I can only make $160 a week for what I earn on UE. The $160 is based on a little more than 8 hours a week I’m allowed to work. By asking us to work 40 hours when we are only allowed to work 8 and taking a pay cut to make it look as if we are not defrauding the government makes me think it is illegal. The company is doctoring our time cards to show that we are only working the minimum hours allowed. What they are basically doing is having the government pay their employees salaries so they can put the money they should pay us in their pocket.

I’d say yes, they are trying to defraud, but of course it is their experience rating (the percentage of UI tax PA employers have to pay on the wages that they are now under reporting that could harm you.

If this company goes belly up…you won’t have enough wages to collect squat if you need to requalify.

You would have good cause to quit because of the illegalities, but you will have to tell the state why. Participating in the scheme puts you at risk because you or any other employee is also committing fraud by acquiescing to the fraud.

Better give your co-workers a heads-up.
