It is too late to file for unemployment?

You told me that I should file for unemployment cause my hours were reduce from when I went on FMLA for maternity leave. I recently found out that my old position is available now but management hasn’t approach me about filling the position. I am considering about asking them if I can fill for it. It’s it too late or should I still file?

Hi Rosemary,

No, it’s not too late to file. You should be entitled. So do it. Ask the employer if you can have your old position back .. if they refuse, all the better for you.

Why didn’t you file for partial unemployment?

Not if you haven’t worked since 2008.

To collect unemployment, one must have qualifying wages in an unemployment claim base period which is basically a look pack period of time.

Even if a state can use what is called an extended base period instead of the other types called a standard, or alternative base period, it’s highly unlikely any state with access to use an extended base period could look back nine years to find those wages required for the minimum to the maximum benefit amount.

Why didn’t you file for partial unemployment?

Hi Chris,

I didn’t file for partial unemployment cause I didn’t know that such thing existed until a family member told me about it.

It’s not too late too file for partial benefits unless the employer puts you back to work full-time. Until that happens, you have every right to file a claim for partial benefits.
