Went through all the proper channels

I was employed as the housekeeping mgr. at a hotel for 28 years.In September of 2009 I went to the G.M. to discuss work issues,specifically maintenance requests that were not being completed.At that time she said she would look into it.Believing her word I went about my work.Two weeks after talking with her and seeing no results I felt that I needed to talk to someone else to see if we could get this resolved.By this time we were writing the same request up 2 or 3 times as it was not being completed.Going through the proper channels I spoke with the owner about the above problem and explained to him that I had went to the G.M. two weeks prior about this situation to no avail.He said he would get to the bottom and get it straightened out.In October 2009 we began having problems with the washing machine.At times, it would not spin out.Then you would have to turn the breaker off behind it to start the cycle over .Sometimes you had to hold the handle down during the spin cycle to get it to complete.Maintenance request was written up for this and the G.M. was informed of this unsafe piece of equip.The base of this unit was very unstable as well; resulting in it shaking horribly.Very unsafe.They did look at it but nothing was corrected.I became very stressed as nothing was being done to correct these issues.The stress ,attributable to this job , began affecting my health and I was put on medication. In staff meetings I would bring up issues that needed to be resolved but again nothing was done. In mid November 2009,prior to a staff meeting that the owner had informed us he would be attending, the G.M. used her position of authority to threaten me that I was to keep my mouth shut and not say anything stupid.She further stated that if I got fired I would never ever collect unemployment.I felt at this time I had went through all the proper channels trying to rectify these problems and because of that I had no option but to quit.

Check your state for what it says about working in unsafe conditions. You might start with the unemployment statutes.

I was told by the HR Dept. that they would not fight this. What do you feel would be the outcome at a hearing?

I think it will depend on you. I think if you go to a hearing that the employer will not be at .. you might have a chance, but all it is going to take for some PA referee to deny is for you to relate information that you did not exhaust all possible alternatives to quitting.

It was actually the threat of being fired and not getting unemployment if you didn’t keep your mouth shut at a meeting which was called to address safety issues .. that caused you to quit .. correct?

That was the final incident. All safety issues aside .. at least that’s what I think an employer would focus on if they were to attend the hearing.

How much effort did you make to resolve this problem?


Feb 10, 2010 appeal hearing

I recieved a letter yesterday from the unemployment board stating that they had scheduled a hearing for my appeal. Going back, I had recieved a form to file an appeal if I so chose.The due date was Jan. 7.I mailed it on Jan. 4 from my home mailbox.On Jan 31 I still had not got a reply from them so I called the # for questions.I was informed that they had never recieved my appeal request.The person I spoke with advised me to fax a letter to them stating what had happened and that this was my 2nd appeal.I did as she said on that same day.I also called the next day to make sure they had recieved my fax.The person I spoke with said they could not tell if it had been or not and she suggested that I send an email just to be safe.She gave me the email address and I emailed my appeal as well.Now the letter I recieved yesterday says that they have scheduled a hearing to see if I had good reason for a late appeal.I swear on my mothers grave I mailed that appeal from my home mailbox.I am just confused over this whole ordeal.Any help is greatly appreciated.

Are you sure that appeal notice’s only issue is good cause for late appeal??

Normally, they would schedule a hearing and include all the issues .. call the appeal office and ask if there’s another notice coming or if they would please consider combining the issues so they can both be heard at the same time.

Make it a request and fax it also .. as well as calling them.

The timeliness of appeal issue .. you need to address it just like you did here.

This is precisely why I recommend always faxing and saving transmittals or sending by certified mail, but you have an argument that once you placed the appeal into the care of the US postal system you can’t be held responsible for whether the appeal section received it .. or lost it.

If I were you .. I’d try to have someone .. a spouse maybe, that will also testify that you did mail it on the fourth or it they did it for you.

I thought I would try to find something more to help you out .. but as usual information about Florida isn’t easy to come by.

FL likes employers I can’t believe this one!

Florida is beautiful and I have a fondness for all the visitors to this site from FL .. but FL’s UI dept .. including the appeal section .. blows.

i CALLED THE OFFICE AS YOU SUGGESTED AND THE PERSON I SPOKE WITH TOLD ME THAT THE HEARING COMING UP WAS ONLY FOR THE TIMELINESS OF MY APPEAL. SHE THEN STATED THAT IF THE REFEREE AGREED THEN THEY WOULD SET UP ANOTHING HEARING FOR THE UNEMPLOYMENT DENIAL.

Did you read those referee rules I linked to? They should be consolidating the issues into one hearing.

Sounds like a typical AWI Florida stalling tactic to me. Call them back and cite the rule.

I live in Pa. and filed my unemployment case there not Florida. I had read your earlier reply but it was stating facts for Florida law .I thought that Pa. law may be different and that is why I was asking for advice on Pa. appeals.
