can an employer lay off an employee for collecting partial unemployment benefits

Employer threatens to lay off employee for collecting unemployment benefits. Can they do this?

Hi,

They shouldn’t, but I know they do.

Stupid too, because then instead of only being charged for your partial benefits .. they’d have to prove they terminated you for willful misconduct to avoid paying the tax increase for full benefits for total unemployment.

In short, I think your employer is a ******* bully and trying to hold employees hostage with the promise of making them fully unemployed if they do what we all, absolutely have a right to do to survive.

What I’m not entirely certain about is whether this would be a viable civil case for “wrongful termination” should you be a compulsive documenter that knows how to prove things.

I hope it is, but I don’t know for certain.

You’d have to ask a lawyer that question.
