Can I appeal because I was late with my continuing claim paperwork – California

(Oakland, CA)

I have been receiving California unemployment for the last few months but then failed to send my weekly form in on time. I had no idea that being late could be cause for termination of benefits! After a telephone interview with EDD, I was sent a denial of benefits letter. I know I have the option to appeal, but are there any grounds for my arguing for benefits because I just wasn’t “together enough” to get my paperwork in on time?

Help!

Hi,

Being late filing the bi-weekly claim should not terminate all benefits, just the weeks you were late filing.

You can appeal the determination, but I’ll tell you….the reason you gave will not be good cause.

I think you need to read the decisions under “Time Limits – claim filing.

Also, read this page in the eligibility guide.
