Decision reversed by ALJ because employer lied at appeal

by Ladonna

(Indiana)

My employer didn’t send sufficient evedence to win at first level so I received a favorable decision. Then they appealed the decision lied at hearing and won with ALJ. The issue was they ask me to take a Supervisor position and I told them i really couldn’t go full time at this time. My boss told me they no longer had a position for me then.

At hearing my employer told ALJ I accepted the job and worked two days in the position then quit.
My hours never changed nor my rate of pay.

I told the ALJ I never accepted the position but he took their word over mine.

That was only one lie of several that was told by them to ALJ. I am preparing for a review board will keep you posted.
