Did I have a chance of winning my unemployment hearing if i was falsely accused of neglect?

The staff wrote false statements blaming me for neglect. They couldn’t give specific dates when it happened.

Anyone care to try to answer this?

Because you ask, ?Did I have a chance?.? I am going to assume that you have passed any window of opportunity that may have been afforded you. This is very unfortunate as I prefer to see people fight and advocate for themselves, especially when an employer wrongfully terminates them and the reason for termination is really being falsified.

Now, from what I have learned from Chris I will say that the moving party was the employer as they appear to have terminated your employment based on these ?false statements claiming you were negligent?. In the hearing, even if they produced these statements, your in person testimony usually trumps anything that is written, such as statements. If these staff members appeared and testified under oath that you acted in a manner that you should not have then their testimony would be more credible. I will also state that you may wish to give more detail regarding what was considered ?neglect?. Was it truly misconduct or was it a mere oversight or a lapse in judgment with regard to your position?

I do not know if the things I mention are the same in Penn. As they are in Cali. But I assume that they are similar. The bottom line is: If you are truly not guilty of any wrong doing then you should have fought!

I think you would have a chance of winning. if you have not been written up or anything for documentation purposes claiming neglect on your part, i think you would have a chance at winning. it wouldnt hurt to go for it.
