Fired for being tardy. Denied unemployment, now I have an appeal hearing.

They have a rule that you can not be late by more than 5 mins. I have two boys and at times I have been 1-5 minutes past this, usually near the two minute mark. The last one that put me over the limit was less than two minutes over the limit.

I tested at top of class each and everytime for actual workskills.

I was denied and have an appeal pending.

Work skills have no relevance with regard to a discharge for being tardy. What does have relevance is the reasons you were tardy.
