I am being laid off in California but getting a severance package. Can I get unemployment benefits?

I may have a choice between taking a lump sum or continuing to receive regular paychecks. Would taking the lump sum allow me to get unemployment benefits immediately?

Hi Anonymous,

What’s important to know is if the state is going to consider the severance as wages.

I think this page needs to read by anyone about to receive severance, because not all severance pay is considered wages in California.

If it’s not considered wages .. it has no effect on unemployment benefits.

If your severance is considered wages I don’t think it will matter how you receive it because it represents ? number of weeks, whether you take it all at once or weekly.
