the referee has just determined me to be eligible for benifits after I had appealed the initial ruling, how fast will they send the money, and since it is a sizeable amt, will it be sent all at once or in increments!!

YeeHaw!! Chris,

This would be an administrative function of a state. But I will make an assumption here (which is always a bad idea:) It will be quick. I’d think you should receive the backpay before you have to file your next continued claim for benefits.

no money till appeal to higher authority

boss has until June 26 to send in appeal!! Would this mean that they will with hold money until they see if she does???

Hi,

You know what .. I’m unsure. I don’t think so. I don’t have the time right now to scour the statutes, but that’s where the info would be .. probably under rules and procedures for hearings.

My instinct is that the board would have to find any appeal valid first and then vacate, or remand the hearing back to the lower level for a de novo hearing .. that’s usually the way PA does it. They remand.

De novo means new .. just like the first one didn’t happen. Who was your hearing officer?

Was the employer present at the hearing?

I never discount the element of luck, but in my experience .. preparation, and knowing what facts to highlight which prove “good cause” works best.

I was out of the area and was late for work. The schedule was changed from 6 pm to 4 pm without my knowledge, but I didn’t get back to the area until after 7, at which time I went straight to work and the boss told me she didn’t need me that she would let me know if she needed me to work on the next eve! When I didn’t hear from her I assumed she had not needed me so I didn’t go in!! The following day I got conflicting statements from two employees as to whether I was to report to work! I called the boss at her second job and she told me she was busy and couldn’t talk, she would call me back!!! She didn’t and when I talked to her on the phone the following afternoon she asked me to turn in my keys, which I did!! She stated on the initial form and at the hearing that she didn’t fire me but the referee said I had a right to assume that she did when she made me turn in my keys!! So it was not job abandonment!!
