They were going to fire me anyway but allowed me to resign in lieu of termination

A hospital is accusing me of stealing narcotics for personal use or to sell to others. Entirely not true in any way and they have no concrete proof. Just hearsay.

Well then, you should be okay .. right? I mean hearsay is pretty much .. “second rate testimony”.

But since the title included information about whether the unemployment department would adjudicate this as a quit or a discharge .. I’m moving this to the questions about being fired and collecting unemployment .. since you say you quit in LIEU of discharge.

Even though you are located in California .. the treatment of a quit in lieu of discharge is treated pretty much the same regardless of which state is of concern. In other words, the employer has the burden to prove the misconduct.
