What may they ask me about a late appeal filed that was not my fault?

I have a hearing based on a late appeal I filed, because
I never received the referee’s decision, the UC center, told me 3 times they had nothing on it. The last call finally gave me a number to call. and I found out, I was denied, so I filed an appeal, which was late of course, so now I have prove in some way, it was not my fault.

I hope you documented those calls. What argument do you have other than you did not receive the referees decision in the mail and that you had called three times to find out about a decision, but when someone finally responded with information .. the appeal was already late .. sounds like good cause for the late appeal to me.

Have you checked the statutes for information on late appeal filings? Some states address what is good cause.
