can i get an unemployment if i quit due to unpaid wages?

My boss is not paying me on time. I am always 2 paychecks (4 weeks) behind. There are no explanations whatsoever. I already filed a complaint with Dept of Labor of NYC. I am planning to quit, do I have a chance to get an unemployment?




Hi Lala,

You will need to go to the NY interpretation index section 1740 D #6 Then make sure you click the link A-750-1847.

That precedent clearly states that the employer must be in violation of the law. The decision itself suggests that the timeframe an employer has to pay someone is dictated by the type of worker they are considered to be.

I urge you to verify that the employer is in violation of the law to assure you have good cause and then gather all your proof together so you can provide or at least offer it to the state when you have your interview.
