Can I get unemployment benefits if I accept an early retirement incentive

My company is having a surplus due to cut back in work load. They are offering 1 years pay as an incentive to retire early as they will be laying off supervisors. Will I be able to file for unemployement under these conditions?



Hi Larry,

You can file .. anyone can file for benefits .. even if they haven't worked:)

But the question is whether you can get unemployment and I don't believe you will be able to because I think it will be considered a voluntary quit .. in other words .. the retirement is not forced in anyway.

Additionally, the years pay would probably be considered severance .. so even if you were found to have quit with good cause .. you wouldn't be able to collect right now anyway.
