Can my assistant apply for unemployment

She's been working for me for 7 or 8 months. she work on the books. I pay all my taxes and her workers comp and liability and everything else, but she has decided to leave because she feels that by moving to Florida she might have a better living, plus her landlord just lost the house where she rents. So she is being forced to move. Can she apply for unemployment even though I haven't fired her.


Hi Just Me,

She can apply for unemployment if she quits to move to Florida ( You might let her know it's worse in Florida than New York to earn a living right now).

Whether she can get the benefits is the big question.

Her reasons as you have related them do not support a finding for benefits in my opinion.
