Failing a random drug and alcohol test in Wisconsin.

(Milwaukee, WI)

I have been driving trucks, buses, vans, etc (of all sizes)for the last 20 years. I was with my last company for 9 years. Last month I was given a random drug and alcohol two hours before my shift and I below a .36. I was let go from the job and I would like to know if would eligible for unemployment benefits.

Hi Shelley,

Apparently Wisconsin doesn't have a specific statute addressing drug and alcohol tests, so it falls under Misconduct, but there is a lot of information about the subject in the Wisconsin Digest of UC decisions

So why you don't first read the decisions and if you see a possibility for getting benefits .. then if you still need help contact me or talk to a lawyer if that makes you feel better.

LAW CHANGE

They just changed the unemployment law in Wisconsin, if you are let go because you fail a drug test or refuse to take one voluntarily you are ineligible for benefits.

Could you provide the web address of the change so I might link to it?
