Haven't received any unemployment benefits or word why not for two weeks.

I worked for my former boss for one year.

This past March I was terminated.

I chose to have a hearing, as the boss told the labor department that I quit, which the judge found to be untrue.

For six months I have been collecting u.i.benefits.

Then just recently my ex boss sends me a certified letter stating that I should return to work for him as my position is still there.

Well when I claimed my weekly benefits I ANSWERED "NO" TO -ANY JOB OFFERS during that time period.

I sent the labor department back their questionaire.

It's been two plus weeks of which I haven't heard/nor seen any money from unemployment.

So now what?


Call the NYDOL and find out when they will be sending you the determination stopping your benefits for misrepresentation and the overpayment notice .. because if you're going to appeal you'll need a determination which actually stops benefits before you can appeal to TRY to get benefits reinstated.

Don't stop filing weekly claims though .. need to do that to get back pay .. if you win.
