I was never a professional hearing representative, but working closely with more than my fair share of independent unemployment hearing representatives while I worked for an unemployment cost control company was how I came to understand it was being represented by someone with extensive knowledge of unemployment law and the rules of procedures governing how the hearing should be conducted, was often the biggest advantage to the employer who stands between you and benefits.
After time getting to know the hearing reps, I came to realize some non-attorney IC reps seemed to have other more intangible personal qualities that made them float to the top of their profession.
Of course they still knew the law and rules of procedure, but they also knew how to used those things innately to win cases, I thought couldn’t be won.
